First off, I invite you to add your own comments to this one, as I am sure there are aspects to this that I am missing, and I have as many questions as opinions about this one. So, woo-hoo!, Hangover 2 gets to open because a judge rules that even though Victor Witmill does own the copyright to the tattoo design he famously put on Mike Tyson that was then imitated in the film, the financial damage of keeping the film closed would effect too many people to be justified. I’d only followed this with amused interest until I heard an “On the Media” report about the possible ramifications of tattoo copyright — and now I have some questions. (On The Media: This Week ”Can you Copyright the Human Body?)

Is it the norm for a tattoo artist to retain the rights to a design they put on someone else’s skin? Or did it only apply in this case because Tyson is a celebrity and the tattoo artist was seizing an opportunity? What a weird idea that somebody else might own something on your skin. (In a related personal opinion of mine, I think that the models we paint at conventions should be allowed to get copies of all the photographs taken of them…and I’ve been arguing that point with people for a while now)

Secondly, how does a non-Maori tattoo artist get to claim intellectual property rites over an obviously traditional style design? When Tyson first appeared with this thing around his eye I remember how he talked about it’s traditional origins and significance, so what about it makes it something that some tattoo artist can claim as original? I mean, really?  (In doing a web search for a common use eligible image of the tattoo I did come across an article from Techdirt about an indignant Maori response to this claim — see the quoted portion below)



However, the larger point I want to make, is what’s up with Tyson’s tattoo in the first place?
From the first I saw it and heard his comments about it, I had to ask: what the….? He talked real big about it being the sign of the warrior and all that, and for a few years afterwards I had all sorts of guys asking me to give them a Tyson Warrior Tattoo. But, what the….?

I’m no expert, just a fascinated artist, but everything I’ve read abut Maori tattoo traditions  (“moko”) say that warriors tattooed their whole face, not just some little bit around the eye, and that a big part of the process is enduring the months of painful work required for the full face. I didn’t go back just now to fact-check this little bit but I distinctly remember reading that only priests wore partial tattoos by the eye. Not only did the warriors tattoo the full face, but the designs were incised so deep that the skin became ridged and grooved like a sculpture. In H. G. Robley’s book, Maori Tattooing, first published in 1896 when the tradition was still in general practice, there is not a single example of a man’s face without extensive tattooing.
On the final night at FABAIC, sitting in the outdoor courtyard after the party, I met a gentlemen who was extensively tattooed. He was a soldier, recently back from service, and he was fascinated by the painted people walking through the hotel. We talked about what I did, but then I got him to tell me about his tattoos. The first two he showed me were Cherokee inspired designs on his shoulders, and then others on his arms and legs. Each one marking a place he had been in the service — some, it seemed, for lessons learned and experiences to be cherished (like a samurai inspired mark down the back of his neck from time in Japan) and some for more painful memories. We talked for a while and at one point he asked me if I had any Native American blood in me, and I said no, but that I knew that he was Cherokee, for I had learned from our talk that he wouldn’t wear a mark unless he’d earned it.

Professor Ngahuia Te Awekotuku, author of Mau Moko: The World of Maori Tattoo, described Mr Whitmill’s claims of ownership as insufferable arrogance. “It is astounding that a Pakeha tattooist who inscribes an African American’s flesh with what he considers to be a Maori design has the gall to claim that design as his intellectual property,” she said. “The tattooist has never consulted with Maori, has never had experience of Maori and originally and obviously stole the design that he put on Tyson…. The tattooist has an incredible arrogance to assume he has the intellectual right to claim the design form of an indigenous culture that is not his.”

Katie Holmes and Suri Cruise photos

Some people work through a divorce by sitting home crying into a bowl of ice cream. For Katie Holmes, there is ice cream involved … but she's certainly not hiding away. Clearly enjoying her new independence, Katie, who filed for divorce from Tom Cruise on June 28, is getting used to life as a single mother — and, boy, is it action packed! The 33-year-old actress and her 6-year-old daughter, Suri, have been all over New York City, including the snack shop Sundaes and Cones in the East Village. On July 3, the gals shared a seat at the treat spot while they snacked on some goodies, and Holmes clearly didn't look brokenhearted, wearing a huge smile on her face during the visit. 

At Sundaes and Cones, Katie and Suri were accompanied by friends — as well as bodyguards. Make that nine bodyguards. It's been reported that after Katie filed for divorce from Cruise, a decision which is said to have "blindsided" the "Rock of Ages" actor, she fired all of his staffers, including his security detail, and replaced them with a new team that was vetted by her Ohio-based attorney father, Martin Holmes.

On July 5, Katie and Suri had a fun-filled day, which started with a visit to Children's Museum of the Arts in SoHo. When the gals arrived, Suri, who was wearing pink and toting a plush toy, had her legs wrapped around her mom as they entered the building with a few other young friends. Katie sported a backless halter top, skinny jeans, and a messy bun for the outing.

After the museum, the mother-daughter duo and some pals grabbed a bite at Alice's Tea Cup on the Upper East Side. The "magical and whimsical tea room" is especially fun for kids because they are offered fairy wings to wear during their meal. After eating, Katie brought Suri to the gift shop and bought her a princess wand, feather headband, and a book, according to Us Weekly. "Suri was extremely happy," an onlooker told the magazine. "She was looking at everything behind the counter and literally said, 'This is the best day ever!'" 

While Katie seems to be enjoying quality time with Suri, she has also been working. On July 2 — just days after her divorce filing — she surprised many by honoring her commitment to appear as a guest judge on "Project Runway: All Stars." Wearing a blue dress, she filmed the spot at Parsons The New School for Design in Union Square. Katie seems to be focusing more on her fashion line, Holmes & Yang, which she collaborates on with her longtime stylist Jeanne Yang. In fact, Katie will present the line for the first time this September during New York Fashion Week. But she's not giving up on acting. She recently completed the movie "Molly," which she co-wrote, and is set to star in a modern version of Anton Chekhov's play "The Seagull." In a new interview in the August issue of Elle, Katie says, "I'm starting to come into my own. It's like a new phase." She wasn't kidding!

Celebrity that guys are most sick of

 
The results are in for AskMen’s fifth annual Great Male Survey, which polled over 50,000 men from around the world on issues ranging from online snooping to what keeps them up at night. But in addition to gauging popular male opinion on a variety of topics, the Great Male Survey also provides a clearer picture on where men stand on public figures – including which celebs have worn out their welcome. And, as it turns out, if it were up to guys, Kim Kardashian and Justin Bieber’s 15 minutes would be just about up.

When asked which female public figures men were most tired of hearing about in 2012, the message came through loud and clear in the survey’s findings:

After generating only 17% of a similar vote in 2011, Kim Kardashian jumped to the top of the list in 2012. And while Kim’s 62% didn’t leave much for the other ladies, maybe “American Idol” producers shouldn’t be too worried about rumors of Jennifer Lopez leaving the show: 9% of AskMen’s readers say they’ve had their fill of J.Lo.

A little more about the Great Male Survey 2012



Meanwhile, other seemingly obvious candidates like Lindsay Lohan avoided guys’ scorn in 2012, though the omission is more a result of the former tabloid mainstay keeping a lower profile in 2012. Instead, more talked-about celebs – like the chart-topping Nicki Minaj – earned more attention, and with it, more votes.

And when it comes to celebrity men, another overly familiar face took over 64% of the 2012 vote: Justin Bieber. Apparently, another year in the spotlight hasn’t made guys any more interested in the teen superstar, who also led AskMen’s voting in 2011. And call it the Kardashian bump, but Kim’s new man, Kanye West, wasn’t far behind.


Thanks to an election year, both Obama and Romney round out the list, but pundits probably shouldn’t take too much stock in the percentage points. Sofia Vergara and Kate Upton also showed up on the list of overexposed women, despite earning the top two spots on AskMen’s Top 99 Women in 2012– proving that just because men may be a little tired of hearing about you, it doesn’t mean they won’t still vote for you when it counts.

Young love! Teens Selena Gomez and Justin Bieber puckered up at the Los Angeles Lakers-San Antonio Spurs game last month -- although she didn't look too thrilled. "That was probably the most humiliating thing that’s ever happened to me,” Gomez said in an interview with Ryan Seacrest afterwards. “All of a sudden we’re both looking up and we come on [the screen] and it’s like… it was so awkward."

For two people who claim they aren't dating, Ashton Kutcher and Mila Kunis sure spend a lot of time kissing!

On Saturday, Kutcher attended the wrap party for his Steve Jobs biopic, "Jobs," in Los Angeles with a special guest in tow: Kunis. During the bash, the one-time "That '70s Show" co-stars sat on the balcony of the venue and looked very cozy. In addition to kissing in plain sight, Kunis sat on Kutcher's lap, wrapped her arms around him, stroked his face, and played with his hair. They didn't appear to be hiding their feelings for one another as other partygoers were nearby while they engaged in PDA.

This latest sighting comes one week after Kutcher, 34, picked up Kunis, 28, from the gym on his motorcycle and they sped off to meet her family at a Los Angeles cemetery. While there, they visited the grave of Kunis’ late grandmother – it was reportedly the anniversary of her death – and Kutcher seemed at ease with Kunis’ family at the intimate affair.

Soon after, they were seen on a sushi date, which was followed by a four-day weekend getaway in the beach town of Carpinteria, California. More recently, they have been seen together frequently in Los Angeles, including at a July 4th barbeque where they were also photographed smooching.


Despite all the signs pointing to a hot romance, Kutcher and Kunis have continuously denied that they are dating. After branding the claim "absurd" back in April, Kunis vented about the rumors in Glamour magazine’s August issue, saying, "Ninety-nine percent of it is bulls—t. That is the biggest form of bullying ever, the paparazzi. Printing lies, making accusations, it's just bullying." And in the August issue of the UK edition of Elle, Kunis, who dated Macaulay Culkin for nearly a decade before splitting in 2011, also denied a romance. "I am totally single," she said. "Listen, we hang out. We've known each other for 15 years. We have mutual friends. We're comfortable with one another. That's it! There's no crazy love story, nothing more."

However, a source told People magazine that Kutcher has long held a torch for Kunis. "He was so in love with her for a while when they worked together. He thought she was a goddess, was always talking about how beautiful she is. But she was with Macaulay for a lot of that time and also just generally gave off a not interested vibe."

Well, let's just say that the vibe she is giving off now says something very different.

Teen Choice 2012 Red Carpet (10 Photos)

Rebecca Black, who became a huge Internet star after her "Friday" music video became a viral hit, arrived on the Teen Choice Awards pink carpet in an orange and white geometric-print blouse and a short, black leather skirt with zippered pockets. The outfit looked youthful on the 15-year-old YouTube sensation, but her top completely clashed with her partially-pink hairstyle. Black is just one of many starlets to try the dip-dyed pink hair trend; including Demi Lovato (the host of this year's show), Lauren Conrad, and Nicole Richie.
